How do I buy water rights in Utah?

What is the difference between a water right and an irrigation share?

A water right is a direct, state-issued authorization to use a specific quantity of water from a specific source for a specific purpose. Irrigation shares are ownership stakes in an irrigation company or ditch company that collectively holds water rights — the company delivers water to shareholders based on each member's share count. Water rights trade with a lot of paperwork and state approval; shares trade more easily but only entitle you to water from that specific company's system.

What is a water share?

A water share is one unit of ownership in an irrigation company, canal company, or other water-delivery organization. Each share typically entitles the holder to a set volume of water per year delivered through the company's system. Shares are common in Utah because many historical water rights are held by companies rather than individuals. The exact volume per share varies by company.

Can I sell my water rights or shares?

Yes. Water rights and irrigation shares are private property and can be sold, leased, or transferred. Certificated water rights require a change application filed with the State Engineer if the new owner wants to change the point of diversion, place of use, or beneficial use.
