How brokerage works

Assignment-based, paid at close.

You and we sign a purchase agreement at your accepted price. That price is yours — it's what you receive at close, full stop. The agreement includes a clause that lets us assign our buyer position to a third party before closing.

We then find a qualified end buyer and assign our position in the agreement to them. The end buyer pays an assignment fee directly to us — separately from your sale — and steps into our shoes to close with you at your accepted price.

From your side, it's straightforward: you sign one agreement, you receive your accepted price at close, and we handle finding the end buyer. We don't collect anything until the deal closes — if we never find an end buyer, you walk away free.

How we handle the law

  • We don't take commissions. We work through two models: cash offers (we buy directly as principal) or assignments (we enter a purchase agreement with you and assign our buyer position to an end buyer who pays us an assignment fee).
  • Water rights are real property in Utah. Selling them on commission requires a real estate license, which is why we use the assignment model instead.
  • Irrigation shares are personal property. Commissions are allowed for shares since no real estate license is required, but we currently use the assignment model for both — same approach, same paperwork.
  • We use escrow and title on larger deals. For deals above a certain threshold or when buyer/seller prefers, we coordinate with title companies and attorneys to hold funds in escrow through closing. For smaller deals, direct funds transfer is also an option — we'll recommend what fits your situation.
  • Not legal or tax advice. We're experts in the water market, not your lawyer or CPA. We'll point out things to discuss with your advisors.

Marketplace listings ($29-49/mo) are self-service — you write the listing, manage inquiries, negotiate with buyers yourself. Brokerage is full-service — we find buyers, handle the deal, and you stay hands-off until close. Marketplace is for confident sellers who want maximum control. Brokerage is for sellers who want help.

How long does it take to sell water rights in Utah?

It varies. Active irrigation shares in popular areas can sell in 2-4 weeks. Specialty water rights or unusual quantities may take 2-6 months. We'll give you a realistic timeline based on your specific water during our first conversation.
